Procedures for Filing a Title IX Complaint
To be used to file allegations of discrimination on the basis of sex against the Robertson County Board of Education or any person or program under the jurisdiction of the board. The following procedures are designed to provide a systematic, local protocol for the resolution of complaints and does not supersede the complainant's right to file charges directly with the United States Office of Civil Rights.
Section I: Filing of Complaints
- Any person alleging discrimination on the basis of sex, including but not limited to sexual harassment, sex discrimination and gender equity shall file such complaint at the lowest applicable administrative level within 180 days of the alleged discrimination.
- Complaints against students shall be filed with the teacher of the alleged victim or with the school principal.
- Complaints against school staff, including teachers, substitute teachers, assistant principals, teacher assistants, cafeteria workers, bus drivers, custodians or school volunteers, shall be filed with the building principal.
- Complaints against building principals, supervisors or central office staff shall be filed with the Director of Schools.
- Complaints against the Robertson County Board of Education shall be filed directly with the Title IX Coordinator for the school system.
- All complaints submitted either written or verbal shall be investigated and shall be documented as to the nature of the complaint and the resolution.
- Complainants shall be requested to submit their complaints in writing; however, in the event the complainant cannot or will not submit a written complaint, the person receiving the complaint must document the nature of the complaint on a complaint form. (The completion of a complaint form by the complainant shall not be required for acceptance of a complaint.)
- A copy of the complaint form shall be provided to the complainant.
- The person against whom the complaint is lodged shall be notified immediately of the complaint and shall be given a copy of the complaint.
- The person receiving the complaint must advise the complainant of the complaint process and his/her right to appeal to the next applicable level.
Section II: Documenting the Complaint
- Written documentation of complaints should contain the following information:
- Name, address, and telephone number of complainant.
- The location and name of the school and entity delivering the service.
- The nature of the incident that led the complainant to feel discrimination was a factor.
- The basis of the complaint, i.e. sexual harassment, gender equity, sex discrimination.
- Names, addresses and phone numbers of people who may have knowledge of the event.
- The date or dates on which the alleged discriminatory event or events occurred.
- All complaints must be copied to the Title IX Coordinator within ten (10) days.
- The complainant shall be notified within thirty (30) days of the findings/resolution of the complaint.
- The Title IX Coordinator shall be notified of the findings/resolution of the complaint immediately after reporting to the complainant.
Section III: Appealing to the Title IX Committee
- Should the complainant disagree with the findings/resolution of the complaint at the initial, the complainant may notify the Title IX committee that he/she wishes to appeal the decision.
- All documentation shall be forwarded to the Title IX Coordinator.
- The Title IX Coordinator shall convene the Title IX committee appointed by the board and shall investigate the referred complaint and respond to the complainant with their findings within thirty (30) days.
Section IV: Appealing to the Director of Schools and the Board
- Within ten (10) days of receiving the committee's findings, the complainant may notify the Title IX Coordinator that he/she wishes to appeal to the Director of Schools.
- All original documentation shall be forwarded to the Director of Schools.
- The Director of Schools shall review the findings and report to the complainant and to the board of education.
- The complainant may request a formal hearing before the board in the event that the complainant fails to agree with the findings of the three previous levels.
